Legal, Privacy & SMS Terms
This page explains the rules governing use of Nova Digital Holdings websites, how personal information is handled, and the terms that apply when you choose to communicate with us by text message.
Effective and Last Updated: August 19, 2026
Terms of Use
These Terms of Use apply to this website and other websites operated by Nova Digital Holdings, LLC (collectively, the “Sites”). By accessing or using a Site, you agree to these Terms. If you do not agree, do not use the Sites.
Nature of Our Business
Nova develops and manages digital assets that may connect consumers with independent third-party service providers (“Operating Partners”). Nova is not a licensed contractor, plumber, restoration company, or provider of the physical services offered by an Operating Partner. A service engagement is between the consumer and the applicable Operating Partner.
No Professional or Investment Advice
Site content is provided for general informational purposes. Research, calculators, illustrations, projections, and examples are not legal, tax, accounting, investment, or other professional advice and are not guarantees of performance or results. You are responsible for evaluating information before relying on it.
Permitted Use
You may use the Sites only for lawful purposes. You may not interfere with Site operation or security; attempt unauthorized access; submit false, fraudulent, or unlawful requests; introduce malicious code; scrape or reproduce Site content at scale without permission; or use the Sites to violate another person’s rights.
Third-Party Services
Operating Partners and other third parties are independent from Nova. Nova does not control and is not responsible for their licensing, availability, pricing, representations, workmanship, acts, or omissions. You should independently review a provider’s qualifications, terms, insurance, and suitability before retaining that provider.
Intellectual Property
Unless otherwise stated, the Sites and their original content, branding, software, research, graphics, and design are owned by or licensed to Nova and are protected by applicable intellectual-property laws. No rights are granted except the limited right to use the Sites under these Terms.
Disclaimers and Limitation of Liability
To the fullest extent permitted by applicable law, the Sites are provided “as is” and “as available,” without warranties of any kind. Nova does not warrant uninterrupted access, error-free operation, or the accuracy or completeness of all content.
To the fullest extent permitted by applicable law, Nova and its members, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from Site use or an Operating Partner’s services. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
Privacy Policy
Scope
This Privacy Policy describes Nova’s handling of personal information through the Sites. An Operating Partner may maintain a separate privacy policy governing information it receives and processes independently.
Information We Collect
Depending on how you use a Site, we may collect:
- Information you provide: Name, email address, telephone number, service address, website address, inquiry details, and other information included in a form, call, email, or text.
- Device and usage information: IP address, browser and device type, referring page, pages viewed, approximate location derived from an IP address, timestamps, and Site interaction data.
- Communications information: The content and status of communications with Nova, including consent and opt-out records where applicable.
How We Use Information
We may use personal information to respond to inquiries; route service requests; communicate about requested services; operate, secure, troubleshoot, and improve the Sites; measure Site performance; prevent fraud or misuse; maintain business records; enforce our terms; and comply with legal obligations.
Cookies, Analytics, and Browser Storage
The Sites may use cookies or similar technologies for essential functionality, preferences, security, and analytics. Analytics services may receive device and usage information under their own terms. The Operational Notepad stores its contents locally in your browser; Nova does not receive those notes merely because you type them into the notepad. You can control cookies and local storage through your browser settings, although disabling them may affect functionality.
When We Disclose Information
We may disclose relevant information to an Operating Partner to fulfill a request; to vendors that provide hosting, analytics, communications, security, or other services on our behalf; when required by law or reasonably necessary to protect rights, safety, and security; or in connection with a merger, financing, acquisition, sale, or transfer of business assets. We do not sell personal information for money.
Mobile-Data Commitment: Mobile information, text-message consent, and opt-in data will not be sold or shared with third parties or affiliates for their independent marketing or promotional purposes. We may provide such information to vendors that support delivery of our messaging program, subject to appropriate restrictions.
Retention and Security
We retain personal information only for as long as reasonably necessary for the purposes described above, including legal, accounting, dispute-resolution, and security needs. Retention periods vary by the type of information and the reason it was collected. We use reasonable administrative, technical, and physical safeguards, but no transmission or storage system can be guaranteed completely secure.
Your Choices and Requests
You may request access to, correction of, or deletion of personal information that Nova maintains about you. You may also object to or request restriction of certain processing where applicable. We may need to verify your identity and may retain information when permitted or required by law. To submit a request, use the contact information below.
Children
The Sites are intended for a general adult audience and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided personal information, contact us so we can review and, where appropriate, delete it.
External Links
The Sites may link to third-party websites. Their privacy and security practices are governed by their own notices, not this Privacy Policy.
SMS / Text Message Terms
When you initiate a text conversation, request text updates, or affirmatively select an SMS consent option presented by Nova or a portfolio Site, you authorize the identified sender to send texts concerning your inquiry, requested service, appointment, or account. If a separate optional marketing consent is presented and you select it, you also authorize the marketing messages described in that disclosure.
- Consent: Consent to receive marketing texts is not a condition of purchasing goods or services.
- Frequency: Message frequency varies with your request and interaction.
- Charges: Message and data rates may apply.
- Opt Out: Reply STOP to opt out. We may send one final message confirming the opt-out.
- Help: Reply HELP or contact us using the information below.
- Delivery: Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed.
We will honor valid revocation requests as required by applicable law. An opt-out applies to the messaging program and sender associated with that request; you may need to opt out separately from a different Operating Partner or program.
General Provisions
Changes
We may update these Terms and this Privacy Policy as our practices, Sites, or legal obligations change. The effective date above identifies the latest revision. Material changes will be communicated when required by applicable law. Continued Site use after an update means the revised Terms govern that later use.
Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles. Subject to applicable law, disputes relating to the Sites or these Terms must be brought in a court of competent jurisdiction in Charleston County, South Carolina.
Severability and Entire Agreement
If a provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. These Terms, together with any additional terms presented for a particular service, form the agreement concerning use of the Sites.
